Second Marriage Permission in Pakistan
Permission for a second marriage in Pakistan is a formal legal process under Section 6 of the Muslim Family Laws Ordinance 1961: an application to the Chairman of the Union Council, a hearing before the Arbitration Council, and — if the Council is satisfied — prior written permission. This guide explains each step.

Quick Answer
Apply to the Chairman of the Union Council, stating your reasons and whether your existing wife consents. The Chairman constitutes an Arbitration Council, which hears the parties and decides whether the proposed marriage is necessary and just. Only the Council's prior written permission satisfies Section 6.
Step 1 — The Application to the Chairman
The process begins with a written application to the Chairman of the Union Council, stating the reasons for the proposed marriage and whether the existing wife's consent has been obtained. The application should be accurate and complete — it frames everything that follows, and inconsistencies damage credibility before the Council.
Step 2 — The Arbitration Council
The Chairman constitutes an Arbitration Council, which includes representation of the parties. The Council hears the husband and the existing wife, considers the reasons advanced, and decides whether the proposed marriage is necessary and just. The existing wife's position is heard and weighed — but the decision rests with the Council, not with her.
Step 3 — The Written Permission
If satisfied, the Council grants written permission, and the marriage may then be contracted lawfully. The permission should be kept safely — it is referenced in the Nikah Nama and is the answer to any later challenge under Section 6. We then conduct and register the nikah with the permission properly documented.
If Permission Is Refused or Bypassed
If the Council refuses, contracting the marriage anyway exposes the husband to the statutory penalties — criminal liability on complaint, the dower consequences, and the existing wife's right to seek dissolution. A marriage contracted without ever applying is in the same position. The lawful route is slower; the unlawful route is not actually cheaper once the consequences arrive.
